Child custody is likely one of your core concerns during your Florida divorce. You probably want as much custody of your children as you can get. The negotiation process, which is often fraught with emotional arguments and legal complexities, can be hard to navigate.

It is easy for parents to make mistakes while negotiating child custody. If you make errors, it may hurt your chances of having custody or visitation. That does not need to happen in your case. Take a look at some of the common custody mistakes below so you know what not to do.

Mistake #1: Putting your interests first

Under Florida law, all decisions regarding children are made with their best interests in mind. This is crucial to remember, especially as you may be dealing with a lot of anger toward your ex. While you may ideally want sole custody or even to relocate your child out of state, this may disrupt the normalcy and consistency your child needs. Make sure you prioritize what is best for your child, which may not always align with what you desire.

Mistake #2: Communicating poorly with your ex

Going through a divorce may cause you to feel a lot of resentment and bitterness. Remember, the courts pay attention to your actions throughout this entire process. Anything you do or say may give your ex fuel to paint you in a negative light. You should show the court you have good character and fitness to be a positive parent. This means to avoid the temptation to send negative emails or disparage your ex on social media. Keep your communications as professional and civil as possible.

Mistake #3: Entering a rebound relationship

It is normal to date when your marriage is ending. You should keep in mind how this may appear while in the process of negotiating the details. The court may not find it beneficial for your child to be in a home with your new partner. Plus, your spouse may be angrier and confrontational if this is the case.
